Revised Practice Act

The main focus for the WVPTA this year has been the passage of the revised Practice Act.  It was introduced as HB 4140 and contains basic updates to the practice of physical therapy, based on the Model Practice Act supported by the APTA. 

The WV House of Delegates passes HB 4140, the WV Physical Therapy Practice Act on February 8 on a vote of 89 yeah and 4 nay and 7 absent.  Voting no were the following: Tim Armstead (R, Kanawha), Pat Mcheenan (R, Hancock), Jonathan Miller (R, Berkeley), Mitch Carmichael (R, Jackson).   The Committee Substitute for HB 4140 includes the minor amendments made in the House Government Organization Committee  requested by the WV Chiropractic Association.

The bill will be referred to the Government Organization Committee in the State Senate and probably the Judiciary Committee. 

Here is a link to an op-ed penned by Delegate Pat McGeehan (R, Hancock) that was in the WV State Journal on February 5, 2010.  It explains why he voted no against the bill.  It also shows that he does not agree with the way licensure board operate in the United States, to protect the public. 

 
Sunrise Report on Licensing Athletic Trainers Released

The Performance Evaluation and Research Division (PERD) of the Legislature reported to the Government Operations Committee their conclusions on the second “sunrise application” from the WV Athletic Trainers Association (WVATA) to license athletic trainers:

  • Does not recommend establishing licensure;
  • If they do move forward with licensure, they should not establish a separate board but rather be licensed under an existing board (physical therapy or chiropractic) that does not duplicate Athletic Trainers’ Association Board of Certification (NATABOC) requirements;
  • Currently there are 252 NATABOC athletic trainers in WV.
  • Currently there are 170 individuals who are certified by the WV Department of Education as athletic trainers to meet the requirements that each high school have a certified athletic trainer present at all football practices and games.
  • The report says requiring licensure of ATs would negatively affect the Department of Education.
  • The cost of state licensure as proposed would exceed the benefits to the public.

The WVPTA is returning to the beautiful centrally located resort--STONEWALL RESORT---April 16, 17, 2011.  The Education Committee is already working on the speakers and topics for next year.  There will also be exhibit area for vendors and fun-filled activities planned for the weekend.  Mark your calendar.
